1. Agreement to Terms

By downloading, installing, or using RemoteX ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and RemoteX regarding your use of the App.

2. Description of Service

RemoteX is a mobile application that allows you to control compatible smart TVs over your local WiFi network. The App provides:

• Remote control functionality for supported TV brands
• Automatic device discovery on your local network
• Keyboard and touchpad input
• App launching capabilities (where supported)

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

4. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for your personal, non-commercial purposes

This license does not include the right to:

• Modify, reverse engineer, or decompile the App
• Rent, lease, or sublicense the App
• Use the App for commercial purposes without our consent
• Remove any proprietary notices from the App

5. Subscriptions and Payments

5.1 RemoteX Pro

RemoteX offers optional premium subscriptions ("RemoteX Pro") with enhanced features. Subscription options include:

• Monthly: Billed monthly, auto-renewing
• Yearly: Billed annually, auto-renewing
• Lifetime: One-time purchase, no renewal

5.2 Payment Processing

All payments are processed through Apple App Store or Google Play Store. By subscribing, you agree to their respective terms of service.

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your device's account settings.

5.4 Refunds

Refunds are handled by Apple or Google according to their refund policies. We cannot process refunds directly.

6. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to any systems or networks
• Interfere with or disrupt the App or servers
• Transmit viruses, malware, or harmful code
• Impersonate any person or entity
• Use the App to control devices you don't own or have permission to control

7. Intellectual Property

The App and its original content, features, and functionality are owned by RemoteX and are protected by international copyright, trademark, and other intellectual property laws.

RemoteX is not affiliated with Samsung, LG, Sony, Roku, Google, Amazon, or any other TV manufacturer. All brand names and trademarks are property of their respective owners.

8. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content or practices of these services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not guarantee that the App will work with all TV models or in all network configurations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMOTEX SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Any loss of profits, data, or goodwill
• Any damages resulting from your use or inability to use the App
• Any unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless RemoteX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

13. Changes to Terms

We may revise these Terms at any time. Changes will be effective upon posting. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your license to use the App will immediately cease
• You must delete all copies of the App
• Active subscriptions may be cancelled without refund for violations

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the country where RemoteX is registered, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiations
2. Mediation if negotiations fail
3. Binding arbitration or court proceedings as a last resort

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and RemoteX regarding the App.
